Terms and Conditions of the Portal
1. DEFINITIONS
1.1. Latvenergo – Public limited company Latvenergo, registration No. 40003032949, registered address: Pulkveža Brieža iela 12, Riga, LV-1230.
1.2. Portal – self-service website of Latvenergo www.elektrum.lv.
1.3. Terms and Conditions – the terms and conditions of use of the www.elektrum.lv portal.
1.4. User – any natural person or legal entity that uses the Portal.
2. GENERAL TERMS AND CONDITIONS
2.1. The objective of these Terms and Conditions is to provide Users with information on the terms of use of the portal and to define the liabilities of the User and Latvenergo in relation to the use of the portal.
2.2. The Terms and Conditions shall specify the User registration, authentication and authorisation procedures, the procedures for adding accounts and additional Users, liability for non-compliance with the Terms and Conditions and other provisions.
2.3. The Terms and Conditions shall apply to all Users, irrespective of whether or not they are registered as a User of the Portal.
2.4. The User has access to the public and authenticated parts of the portal.
2.5. Latvenergo shall provide access to the portal 24 hours a day, 7 days a week, except for in the cases where the operation of the portal is disrupted due to circumstances beyond the control Latvenergo, or where upgrades or maintenance works are being performed.
2.6. The authenticated part is accessible to authenticated Users who have authenticated themselves in the portal with the help of any of the authentication tools offered in the portal.
2.7. The basic information services provided in the portal are free of charge.
3. USER ACCOUNT
3.1. After the initial registration or authentication on the portal, a User Account is created for each User, which displays information related to the User.
3.2. In your User Account, you can enter into contracts, pay for goods and services, update your data, add or delete additional Users, as well as use other features provided by the portal.
3.3. Users can authenticate by using a username and password or secure authentication methods (online banking authentication, SmartID or eParaksts/eParaksts mobile). In the event of secure authentication, the User has access to the full functionality of the portal. With username and password authentication, users have access to limited portal functionality (for instance, no access to the conclusion of contracts, product change, offer confirmation, etc.).
3.4. Latvenergo shall delete the User Account and/or the additional User:
3.4.1. when a User request is received;
3.4.2. if a request of an additional User to delete their data as an additional User in the User Account is received;
3.4.3. if the User Account has not been in use for more than 12 months;
3.4.4. if Latvenergo has reasonable grounds to suspect that the unauthorised use of a User Account is in progress.
4. USER RIGHTS, DUTIES AND LIABILITY
4.1. The User shall be entitled to:
4.1.1. receive support in the use of the portal by calling 8400 during the Elektrum Customer Service opening hours;
4.1.2. add, edit and delete additional Users in the User Account;
4.1.3. determine the scope of additional User access rights to the User Account and the information contained therein, including contractual and payment information.
4.2. The User shall have the duty:
4.2.1. to read and comply with these Terms and Conditions;
4.2.2. to prevent the disclosure of authentication data to third parties and their access to the data available in the authenticated part of the portal;
4.2.3. to update his/her personal data and/or the personal data of the additional User provided in the User Account if it is incorrect or outdated, by providing true and up-to-date personal data, including the updates of information on the name, surname, personal identification number, e-mail, telephone number and other related information, by making the changes to the User Account in the portal or by sending the relevant request to klientu.serviss@elektrum.lv;
4.2.4. not to take any action that would be directed against the security, stability or performance of the Portal or not to use the Portal to achieve any illegal activities.
4.3. The User is responsible for all activities that he/she or a third party that is using the User Account performs while using the Portal.
4.4. The User shall be liable for any consequences incurred by Latvenergo and/or third parties as a result of the actions of the User while using the Portal.
4.5. If the User detects any unauthorised activity or availability of the access data to the Portal by a third party, the User must immediately inform Latvenergo by sending the information to the e-mail address klientu.serviss@elektrum.lv and/or by calling 8400.
5. LATVENERGO RIGHTS, DUTIES AND LIABILITY
5.1. Latvenergo is entitled to interrupt the operation of the Portal or individual sections thereof if it is necessary for the maintenance, servicing or upgrading of the Portal. If the interruption of Portal operation or operation of individual sections of the Portal is planned, an informative notice will be posted.
5.2. Latvenergo shall be entitled to restrict or terminate User access to the Portal and to the User Account if the User violates or fails to comply with these Terms and Conditions, instructions of Latvenergo or the effective laws and regulations of the Republic of Latvia.
5.3. Latvenergo shall ensure the confidentiality of User data by complying with the security standards for limited access information and information systems and by ensuring that the data contained in the Portal is protected against unauthorised access, disclosure, modification or any other unauthorised processing.
5.4. Latvenergo shall not be liable for any interruptions in the operation of the Portal if they are caused by damage or malfunction of the equipment of the User or by the improper or unlicensed use of equipment or software.
5.5. Latvenergo shall not be responsible for the non-availability of the communication channels specified by the User. Information sent to the communication channels specified in the User Account will be deemed to have been communicated to the User at the moment of transmission thereof.
5.6. Latvenergo shall not be liable for any damages incurred by the User if a third party uses the Portal with the use of personal authentication means of the User.
6. PERSONAL DATA PROCESSING
6.1. The controller of the personal data is Latvenergo AS, registration No. 40003032949, legal address: Pulkveža Brieža iela 12, Riga, LV-1230, e-mail address: info@latvenergo.lv. E-mail of the data protection specialist: fpda@latvenergo.lv.
6.2. By using the Portal, the User is aware that Latvenergo will process the personal data for the registration and authentication of the User, for the further provision of services, for servicing the User in the Portal and ensuring the fulfilment of the mutual obligations and protection of other legal interests, by observing the requirements for the processing and protection of such data as provided for by the laws and regulations.
6.3. By registering, authenticating and performing operations in the Portal, the User confirms that the data provided by him/her are true and up-to-date and that there is a legal basis for the processing thereof. When transferring data of another person to Latvenergo, the User is responsible for ensuring the legal basis for the processing of the data of another person and undertakes to provide the respective person with information about the processing of the data performed by the User in the Portal and the transfer of the data to Latvenergo. The User assumes responsibility for the use of the data of another person and is aware that he/she may be held liable in accordance with the procedures established by the laws and regulations, as well as may be subject to claims for damages resulting from such actions.
6.4. Additional information on the processing of other personal data is provided in the Principles of Customer Personal Data Processing, which are available at www.elektrum.lv/dati or are sent upon request in printed format to the address specified in the respective request.
7. COPYRIGHT
7.1. The materials, images and information published in the Portal are the property and copyright of Latvenergo and are protected in accordance with the laws and regulations of the Republic of Latvia.
7.2. The reproduction or use of materials, images and information published in the Portal without the written permission of Latvenergo is prohibited.
8. FINAL PROVISIONS
8.1. The following web browsers are supported for the use of Portal functionality in desktop mode: Google Chrome, Microsoft Edge, Safari and Mozilla Firefox, as well as the following operating systems: Windows and macOS, while the following web browsers are supported on mobile platforms: Google Chrome and Safari, as well as iOS and AndroidOS (the latest versions of browsers and operating systems must be used to enjoy the full functionality of the Portal). The use of other browsers and operating systems may not provide the full functionality of the Portal.
8.2. Latvenergo reserves the right to amend the Terms and Conditions of Portal Use. Changes shall take effect when they are published in the Portal.
8.3. The operation of the Portal is managed in accordance with the effective laws and regulations of the Republic of Latvia.
8.4. Any dispute that cannot be settled in an out-of-court procedure shall be adjudicated by a court instance of the Republic of Latvia.
8.5. Latvenergo does not limit the right of the Portal User to apply to the competent state authorities for the protection of his/her rights in any way.
The Terms and Conditions shall enter into force on May 12th, 2025.
